1. About Us
Hndmark ("the Service") is a product operated by Bowley Design Ltd, a company registered in England and Wales under company number 05762792, with its registered office at Brandon House, First Floor, 90 The Broadway, Chesham, Bucks, HP5 1EG, UK ("we", "us", or "our").
2. Acceptance of Terms
By accessing the Service, enabling paid features, or purchasing a license, you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
3. The Service
Hndmark is a web-based tool that lets users markup screenshots and images with hand-drawn annotations and allows users to export the markedup images.
Free Users
Free users may use the Service with limited features and watermark on downloads.
Paid Users
Upon payment of a one-time fee, users are granted a license to access advanced features, remove limitations, and use exported images for commercial purposes.
Delivery
The Service is delivered via browser. No physical product will be shipped.
4. Payments & Merchant of Record
Our order process is conducted by Lemon Squeezy, who acts as the Merchant of Record for all orders.
Contract: When you purchase a license, your contractual relationship for the transaction is with Lemon Squeezy, subject to their Terms of Service.
Taxes (VAT): Lemon Squeezy handles VAT and sales tax collection and compliance as required by applicable law.
Refund Policy: In accordance with applicable consumer protection laws regarding digital content, you may waive your right to a cooling-off period once access begins. However, as a gesture of goodwill, we offer a 14 day money-back guarantee if the software does not function as described.
5. User-Generated Content & Responsibility
You retain full ownership of the screenshots, images, and content you create, upload, or edit using Hndmark.
Liability: You represent and warrant that you own or have the necessary rights to use any content you process through the Service. Bowley Design Ltd is not responsible for copyright infringement or misuse of third-party materials.
Prohibited Content: You may not use Hndmark to create or distribute content that is illegal, hateful, explicit, or promotes violence.
Data Privacy: Hndmark processes images locally in your browser. we do not store uploaded images on our servers.
6. "Lifetime Deal" Definition
A one-time payment grants access to Hndmark paid features for the Lifetime of the Product.
This does not mean the lifetime of the user. If Bowley Design Ltd ceases operations, discontinues the Service, or is acquired, we will make reasonable efforts to notify users, but the Service is not guaranteed to exist indefinitely.
7. Intellectual Property
Your Output: You own the images and files exported from Hndmark. You are granted a worldwide, royalty-free license to use them for personal or commercial purposes.
Our Code: You may not reverse engineer, decompile, or attempt to extract the source code of Hndmark. The software, UI, and underlying logic remain the intellectual property of Bowley Design Ltd.
8. Limitation of Liability
Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, or for fraud.
Subject to the above, Bowley Design Ltd shall not be liable for any indirect, incidental, or consequential damages, including loss of data, business interruption, or loss of profits arising from use of the Service.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
